The following terms of service are common to all customer accounts hosted by WinterMedia where not explicitly different in the signed customer contract document. They were last updated in August 2011. WinterMedia reserves the right to modify these terms at any time.

Terms

Services shall mean any services provided by WinterMedia including but not limited to web hosting, email hosting and consultancy services

Agents shall mean any company or person acting on behalf of WinterMedia in providing the services, including but not limited to the datacenters and other server hosting providers onto or within which WinterMedia places it's customers accounts.

Warranty

The services come as described by WinterMedia on an as-is basis with no warranty. WinterMedia will do it's best to deliver the service as described but circumstances beyond WinterMedia's control may disrupt this service.

Limitation of Liability

WinterMedia shall not be liable for loss of service due to circumstances beyond it's control, including but not limited to network outages caused by hardware failures, DNS propagation times when a IP address change is necessary, circumstances resulting from unauthorized access to customer accounts and situations caused by customer's losing login credentials or release of credentials to 3rd parties however so caused.

Account Suspensions and Terminations

WinterMedia and it's agents reserve the right to monitor all customer accounts for suspicious activity and temporarily or permanantly suspend accounts that they believe have been accessed by an unauthorized party, or are themselves attempting unauthorized access of any other account at WinterMedia or any other company, or any other unlawful activity. Terminations result in the loss of all service and all data stored within the customer account including web sites and Email, and typically result from virus, malware or hacking scripts being injected into all parts of an account where WinterMedia and it's agents have no feasible way of cleaning up.

Backups

WinterMedia or it's agents will retain backups of customer accounts in the event of total loss. However, WinterMedia and it's agents reserve the right to delete backups when they suspect that malicious software has been placed there. In this case the backup cannot be used to recover customer data.

Your Responsibilities

It is your responsibility to keep your account secure. To do this we recommend you use cPanel's built in password generator for choosing a new password, or at least choose a password that contains all of the following: Upper and lower case letters, numbers and special characters.

The password you use for your WinterMedia account and all parts thereof should not be used for any other web site or service that you use.

You must keep your password safe and secure at all times. To assist in remembering passwords, WinterMedia recommends the use of password vault software.

You must not divulge your password to any other person - not even someone claiming to be WinterMedia or one of it's agents.

If you believe that your account or passwords have been compromised, you must let WinterMedia know as soon as possible, either through phone, email or skype, and change your passwords immediately.
